Häagen-Dazs The Perfect Cup Contest Rules (the “Rules”)
By entering the Häagen-Dazs The Perfect Cup Contest (“the Contest”), you agree to be bound by these Häagen-Dazs The Perfect Cup Contest Rules (the “Rules”) and the Decisions of Bombbash Interactive Inc., which are final and binding in all matters related to the Contest. Winning a prize is contingent on fulfilling all the requirements set forth in the Rules. The Contest is void where prohibited.
The Contest is governed by the laws of Ontario and the laws of Canada applicable therein and is subject to all applicable federal, provincial, territorial, state and local laws and regulations. In the event that any requirement or stipulation under the Rules is held to be indefinite, invalid, illegal or otherwise voidable or unenforceable in a country, province, territory or state, the balance of the Rules continue in full force and effect.

The Contest is open to all residents of Canada who have reached the age of majority according to the laws of the province or territory which they reside.
Employees of Häagen-Dazs, Straticom Group Ltd. and Bombbash Interactive Inc., their parent, affiliated or related companies, subsidiaries, divisions and all advertising, media buying and promotional agencies, and Contest judges or any of their respective affiliates, subsidiaries and advertising agencies, such employees’ immediate family (father/mother, brother/sister, son/daughter, husband/wife/common law spouse) and persons living under the same roof with said employees are not eligible to enter the Contest.
3. Contest Period:
The Contest begins at 12:01 am Eastern Time (“ET”) on July 1, 2013 and concludes at 11:59 pm ET on July 31, 2013 (the "Contest Period").
The Contest Engine is the official time keeper for the Contest. Contest Registrations received outside the Registration Period may be disqualified from the Contest.
The Sponsor, Administrator and Contest Engine assume no responsibility for garbled, lost, late, incomplete, invalid, unintelligible, delayed, destroyed or misdirected Contest Registrations, mail, voice messages, e-mail or any computer errors or malfunctions. Such Contest Registrations will be disqualified. Proof of sending Contest Registration will not be deemed to be proof of receipt.

5. Game Mechanics (How potential Winners are selected)
‘Prize Spark’ Game
How Prize Spark Works:
Draws called “Spark Draws” randomly select Potential Prize Winners from all of the valid Contest Registrations. A clock counts down to the next Spark Draw – you can even watch where the spark lands (it could be you!). EVEN if it’s NOT YOU, if a spark lands on anyone in your Network, you are a potential winner too. Watch the Prize Spark video to see how to get people in your Network.
Once you successfully complete and submit a Contest Registration, you are automatically entered into every subsequent Spark Draw. Additionally, you will be provided a unique link that can be used to increase your chances of qualifying to win a prize by getting people to join your Network.
Odds of being selected as a Potential Prize Winner or Connected Potential Prize Winner depend on the number of Contest Registrations received and the number of Connections in your Network at the time of each Spark Draw.
Anyone who accesses the Contest and submits a Contest Registration by way of that unique link will be a 1st degree Connection in your Network. If an individual is sent multiple unique links regarding this Contest, they may only use one link to access the Contest and submit a Contest Registration. When individuals access the Contest and submit Contest Registrations by way of your 1st degree Connection’s unique link, they will be a 2nd degree Connection in your Network. When individuals access the Contest and submit Contest Registrations by way of your 2nd and 3rd degree Connection’s unique link, they will be a 3rd and 4th degree Connection, respectively, in your Network. Your Network includes you, your 1st degree Connections, your 2nd degree Connections, your 3rd degree connections and your 4th degree Connections (together, “Your Connections”).
If you access the Contest and submit a Contest Registration by way of a unique link provided by a Previous Registrant, you will be a Connection in their Network, however they will not be a Connection in your Network.
Through your Bombbash ™ Account, you can monitor your Network and see certain information about Your Connections in your Network, like how many Connections they have. The more Connections in your Network, the greater your chances of qualifying to win a prize.
How your Network helps you Win
Each Spark Draw will select a Contest Registration (“Potential Prize Winner”) at random from all the valid and eligible Contest Registrations received at the time of said draws. If that Potential Prize Winner is someone in your Network, then you are a Connected Potential Prize Winner.
Being selected as a Potential Prize Winner or identified as a Connected Potential Prize Winner does not mean that you have won a Prize. Awarding of Prizes to Potential Prize Winners and Connected Potential Prize Winners is subject to the Winner Validation Process (see below).
When a Potential Prize Winner is selected, up to four (4) individuals whose Networks include the Potential Winner are identified as Connected Potential Prize Winners.
For example, Alan submits a Contest Registration for the Contest and is provided a unique link. Alan provides the link to Bob, Betty and Becky who all register and submit Contest Registrations through this unique link. Bob, Betty and Becky become 1st degree Connections in Alan’s Network. Betty gets her own unique link and provides it to Carrie, Chris, and Charlie who all register and submit Contest Registrations through Betty’s unique link. Carrie, Chris, and Charlie become 1st degree Connections in Betty’s Network and 2nd degree Connections in Alan’s Network. If Betty is selected as a Potential Prize Winner, Alan will be automatically selected as a Connected Potential Prize Winner. However, if Betty is selected as a Potential Prize Winner, Carrie, Chris and Charlie will not be automatically selected as Connected Potential Prize Winners.
The more Connections in your Network, the greater your chances of qualifying to win a prize.
In the event that a Potential Prize Winner or Connected Potential Prize Winner are disqualified for any reason, the Contest Engine may, at their sole discretion, award the applicable Prize(s) by either (i) selecting up to four (4) Supplementary Potential Prize Winners or (ii) conducting a Limited Spark Draw from among all remaining eligible Contest Registrations. Supplementary Potential Prize Winners are those who are not already qualified as Connected Potential Prize Winners and who’s Networks includes the Connected Potential Prize Winner who has the Potential Prize Winner as a 1st degree Connection, 2nd degree Connection, 3rd degree Connection or 4th degree Connection, in that order. A Limited Spark Draw is conducted in the same manner as a Spark Draw but with the modifications necessary to limit the number of Connected Potential Prize Winners to the number of available prizes.
Potential Prize Winner & Connected Potential Prize Winner Selection
Prizes will be awarded by (33) thirty–three Spark Draws each day at approximately 12:00:00 pm EST (noon). Each Spark Draw will select a Potential Prize Winner at random from among all valid Registrants received at the time of that Spark Draw.
Subsequent to each Spark Draw, the Contest Engine will identify and notify Connected Potential Prize Winners by identifying the Contest Registrations who’s Networks contain the Potential Prize Winner selected by that Spark Draw.
Each Contest Registration may only be identified as being any of a Potential Prize Winner or Connected Potential Prize Winner one (1) time per calendar day.
Contest Registrations that have been identified as either Potential Prize Winners or Connected Potential Prize Winners one (1) time in a calendar day will be disqualified from any subsequent Sparks Draws in the remainder of that calendar day. The Contest Engine may identify a Potential Prize Winner or Connected Potential Prize Winner by selecting Supplementary Potential Prize Winners or conducting a Limited Spark Draw.
Potential Prize Winners and Connected Potential Prize Winners will be notified on-screen on the Contest website or when you log into your Bombbash ™ Account or via email.
Connected Potential Prize Winners are subject to the same general rules as Potential Prize Winners and may be awarded a Prize subject to the Winner Validation Process.
The Contest Engine’s decisions as to the administration and operation of the Contest and the selection of Potential Prize Winners and Connected Potential Prize Winners are final and binding in all matters related to the Contest.
Claiming your Prize (Winner Validation Process)
If you receive a notice indicating you are eligible to win a prize as a Potential Prize Winner or a Connected Potential Prize Winner, you must respond to the notification within seven (7) days to initiate the Winner Validation Process. Failure to respond within seven (7) days of notification will result in disqualification. No Prize will be awarded to a Potential Winner unless they have completed the Winner Validation Process.
To complete the Winner Validation Process, you will be asked to claim your prize by electronically answering unaided, a time limited mathematical skill testing question and to agree to a declaration of compliance with the Rules and a release (including a publicity release) in order to be confirmed as a Winner of a Prize.
Once the Potential Prize Winner has completed these steps and otherwise complies with the Rules, a confirmation will be emailed as verification and the Prize will be delivered.
By accepting a prize, winners authorize the Sponsor/Contest Engine to broadcast, publish and disseminate their names, city and province of residence, photographs, likenesses, comments and voices, in connection with any promotion or publicity at no further compensation to the winners.
In the event that a potential winner is disqualified, not eligible or does not correctly answer the mathematical skill testing question within the time limit, the required documents are not agreed to by the potential winner and successfully transmitted to Sponsor, Contest Administrator or Contest Engine within the required timeframe, or he/she does not otherwise comply with the Rules, he/she shall not be awarded the prize and that prize shall not be awarded, and Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
In the event of a dispute as to any Contest Registrations or Bombbash ™ Accounts, the authorized account holder of the email address listed in the Contest Registration will be deemed to be the registrant or Registrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential Prize Winners and Connected Potential Prize Winners may be required to show proof of being the authorized account holder.
The Sponsor, Administrator and Contest Engine are not responsible for Prizes that are undeliverable due to incorrectly typed or incomplete addresses.
Sponsor, Administrator and Contest Engine reserve the right to cancel, suspend and/or modify the Contest, or any part of it for any reason. A Potential Winner is not a Winner of any prize, even if the website should so indicate, unless and until the Potential Winner is identified as a Winner in the Contest Engine’s database and the Winner Validation Process is complete.
The Sponsor, Administrator and the Contest Engine will not accept screenshots or other evidence of winning in lieu of the Winner Validation Process. Any notification that occurs after the system has failed for any reason is deemed defective and is void and will not be honoured. The Sponsor, Administrator and the Contest Engine reserve the right in their sole discretion to disqualify any individual or resulting Contest Registrations they believe to be or result from tampering with the Contest Registration process or the operation of the Contest or to be acting in violation of these Rules or any other promotion or in an unsportsmanlike or disruptive manner. In the event of termination of Contest, Winners may be selected from Contest Registrations received prior to termination. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor, Administrator and the Contest Engine respectively, reserve the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor, Administrator and the Contest Engine’s failure to enforce any term of these Rules shall not constitute a waiver of that provision.
6. Contest Registration Conditions and Release
Limit one Contest Registration per Bombbash ™ Account per person, per email address, or Facebook account.
Multiple participants are not permitted to share the same email address, Bombbash ™ Account or Facebook account. Any attempt by any participant to register more than one Contest Registration or Bombbash ™ Account by using multiple/different email addresses, Facebook accounts, identities, registrations and logins, or any other method will void that participant's Contest Registrations and Bombbash ™ Account and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.
By submitting a Contest Registration, you (the “Registrant”) agree to: (a) comply with and be bound by these Rules and the decisions of the Sponsor, Administrator and Contest Engine which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Sponsor, Administrator, Contest Engine and [Facebook] and their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s Contest Registration, creation of a Contest Registration or submission of a Contest Registration, participation in the Contest, acceptance or use or misuse of any prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of Contest Registration; and © indemnify, defend and hold harmless the Sponsor, Administrator and Contest Engine from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an Registrant’s participation in the Contest and/or Registrant’s acceptance, use or misuse of prize.
Except where prohibited, your participation in the Contest constitutes your consent to allow the Sponsor, Administrator, Contest Engine and its agents to use your name, and/or hometown and state or province for any purposes in any media, worldwide, without further payment or consideration.
8. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Registrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; © unauthorized human intervention in any part of the Contest Registration process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of Contest Registrations; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Registrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an Registrant’s Contest Registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the Registrant’s sole remedy is another Contest Registration in the Contest. No more than the stated number of prizes will be awarded.
You, the Registrant, agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the Ontario Superior Court of Justice located in Ottawa, Ontario; © any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (d) under no circumstances will the Registrant be permitted to obtain awards for, and the Registrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Registrant and the Sponsor and the Administrator in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
